Virginia’s current unclaimed property law generally follows the
common law doctrine with regard to tangible personality, giving
ownership to the first person to take physical possession, (Ariana Marshall) except
for statutory provisions governing abandoned motor vehicles, property
abandoned in safe deposit boxes, unclaimed property voluntarily
reported to the Commonwealth, and unclaimed property held
in the ordinary course of business.

Norman Cummings states ” I began to search inside and then outside until about 1 am no result. I searched for days all through the neighborhood. No one had seen him or knew anything. Deb Keeling can attest that she was never asked.
He goes on to say he saw the dog in Steve Marshalls yard a week later. Considering the myriad complaints made to his landlord Sheriffs Deputy Brian Hubbard and to law enforcement in general why then did he not report this for four months? The incident on July 28, 2020 was known to Mr. Hubbard as it happened. The alleged lug nut incident on 11.21.21 resulted in an immediate 911 call. Angela Cummings states “March 15, 2021 Talked to shelter and they never saw him and took in any dog”
This was a day that Mrs. Cummings returned from Louisiana to retrieve belongings.
Why was there no bolo given on the shelters Face Book page? This is the common method in Patrick county to find missing pets and livestock.
I believe this to be another fabrication coached by Deputy Williams and perhaps Hubbard. This would follow a pattern given the fact that Deputy Williams is on video coaching Mr. cummings as to a date to put on his statement. This video also demonstrates prior discussion about the written statements by the trio. Deputy Williams should be compelled to show evidence and any witness to this alleged call. Deputy Williams is the county Dog Warden and as such is a figure of authority at and works out of the county animal shelter.
In summation the Cummings abandoned the dog and only took an interest again when it suited them to “get” Mr. Marshall. See motive for charges (here)
